Meta, Microsoft, And Hundreds More Own New Twitter Name Trademarks

Legal issues could arise as a result of the decision made by billionaire Elon Musk to rebrand Twitter as X. A number of companies, including Meta  and Microsoft, already have intellectual property rights to the same letter.Due to new Twitter name trademarks X which is so commonly used and referenced in trademarks, it is a contender for legal challenges.

The corporation that was formerly known as Twitter may in the future face its own hurdles when attempting to defend its X brand.

“There is a 100% chance that somebody is going to sue Twitter over this,” said trademark attorney Josh Gerben, who claimed he tallied almost 900 active U.S. trademark registrations that already cover the letter X across a wide variety of businesses. “There is a 100% chance that somebody is going to sue Twitter over this,” said Josh Gerben.

On Monday, Musk rebranded the social media platform previously known as Twitter as X. He also introduced a new logo for the platform, which is a stylized black-and-white rendition of the letter.

The owners of trademarks, which protect things like brand names, logos, and slogans that identify sources of goods, might claim infringement if rival brands would cause confusion among consumers. Trademarks protect things like brand names, logos, and slogans.

The possible redresses vary from monetary damages to the prohibition of use. Microsoft has owned an X trademark since 2003, and it is tied to communications about the company’s Xbox video game console. Meta Platforms, whose Threads platform is a new competitor to Twitter, is the owner of a federal trademark that was registered in 2019 covering a blue-and-white letter “X” for industries including software and social media.

This trademark is owned by Meta Platforms. Gerben stated that it was likely that Meta and Microsoft would not suit unless they were threatened that Twitter’s X encroaches on the brand equity that they developed in the letter. Requests for comments from the three businesses were not responded to.

When it was still known as Facebook, Meta faced accusations of violating intellectual property rights when it changed its name. It is currently defending itself against trademark complaints that were launched against it last year by investment firm Metacapital and virtual-reality business MetaX.

Additionally, it settled a case about its new logo, which has an infinite sign. And even if Musk is successful in changing the name, there is still the possibility that others would claim ‘X’ for themselves. Douglas Masters, a trademark attorney at the legal company Loeb & Loeb, stated that “given the difficulty in protecting a single letter, especially one as popular commercially as ‘X,’ Twitter’s protection is likely to be confined to very similar graphics to their X logo.” ”
